“SITS” means SEOintheSUN, which is a brand of FU International Academy Tenerife or Formación FU, S.L. with a principal place of business at CC La Cúpula, Local 69, 38400 Puerto de la Cruz, Tenerife, Spain.
“Client” means any party entering into this Agreement.

Client’s use of SITS’ marketing services (the “Services”) and SITS’ trainings (the “Trainings”) is subject to the terms set forth below (this “Agreement”) and is between Client and SITS.

In order to use Services and Trainings, Client must first agree to this Agreement.

Client accept this Agreement by clicking to accept or agree to this Agreement, where this option is made available to Client by SITS in the booking form for any Service and Training.

SITS reserves the right to modify these Terms of Use without notice and any modifications are effective when they are posted here.

Copyright & Use of content: SITS maintains copyright protection in all materials, information and publications published on the website under www.seointhesun.com and used in the Training. You may not use, download, upload, copy, print, display, perform, reproduce, publish, or distribute any web site or Training information, in whole or in part, without prior written consent.

You must provide a valid email address and any other information requested in order to complete the signup process of SITS Services and/or Training. You further agree to timely update such information as such information changes.

SITS reserves the right to terminate your use of Services and/or Training upon the discovery that the information you provided is not complete or accurate.

SITS may modify, suspend or discontinue Services and/or Training at any time, for any reason, at its sole discretion. SITS reserves the right to refuse Services and/or Training to anyone for any reason at any time.

GOVERNING LAW. You agree that these Terms and Conditions shall be treated as though they were executed and performed in Santa Cruz de Tenerife (Spain) and shall be governed by and construed in accordance with the laws of Spain.

You can buy a service on the respective service landing page. For each service, you will have to provide us with some general information about you and your website (including, but not limited to name, website URL, contact information, …). Additional information that we might need depending on the nature of a service is clearly stated on each service website, before you make the payment. In order for us to offer these services at these affordable prices, we cannot provide consulting or special requests – what you see it what you get.

After you have made the payment, you will be redirected to an online form in which we will collect all the necessary information. In order for us to conduct a service, you have to fill out this form, and by making the payment, you agree to provide us with that information. You information is always collected via s secure connection. You can contact us at team(at)seointhesun.com should you encounter any technical difficulties or need us to re-send you the link to the form.

Your use of the services is at your sole risk. You acknowledge, understand and agree that SITS provides the service to you “As Is” and “As Available” without warranty or condition of any kind.
SITS shall not be responsible for any inaccuracies related to your product or business, and SITS shall not be responsible or liable for conducting any services that may negatively affect or damage your product or business.

You consent to SITS publishing your company name on SITS’ website/portfolio for SITS’ promotional use, although you reserve the absolute right to require the removal of your company name on our website.

You understand that SITS uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run and manage the service.

You acknowledge, understand and agree that SITS cannot guarantee the security of your data while it is being transmitted over the Internet and through servers that are out of our control.

You agree to defend, indemnify, and hold harmless SITS its officers, directors, employees and its agents from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, made by any third party due to or resulting from your use of the service or your violation of this Terms of Service.

SITS respects the privacy of its clients and the confidentiality of the information that you provide to SITS in connection with the services provided by SITS, such as email addresses of your customers. SITS will never disclose or sell such information to any third party without your permission subject to any disclosures required by law or properly issued subpoena.

You agree to receive administrative and legal notices about the service electronically via email.

The failure of SITS to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and SITS and govern your use of the service, superseding any prior agreements between you and SITS (including, but not limited to, any prior versions of the Terms of Service).

SITS does not warrant that:

• The service will be uninterrupted, timely, secure, bug or error-free.
• Any errors or bugs in the service will be corrected.
• You expressly understand and agree that SITS shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if SITS has been advised of the possibility of such damages), resulting from your usage of the services.

All Services have to be paid upfront through our payment provider.

Refunds are not available after your purchase.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

You are solely responsible for properly cancelling your account. You may cancel your SITS services at any time by contacting us by email to team(at)seointhesun.com . You will no longer be charged after your current term is completed.

There is no cancellation fee.

There will be no refund if you cancel the service before the end of your current, paid-up month or quarter, and you will not be charged or billed thereafter.

Group size: Our groups consist of a minimum of 6 and a maximum of 16 participants. If a group has between 3 and 6 participants, FUIA reserves the right to reduce the class time. If there are only 1 or 2 participants, FUIA reserves the right to cancel the course up to 6 weeks before the scheduled start date if the minimum number of participants is not met. To prevent any inconvenience, we strongly suggest securing travel insurance to cover potential cancellations.

All cancellations must be made in written form. The cancellation date will be the date on which SITS receives the written cancellation.

We strongly recommend that students arrange insurance cover to protect themselves against the possibility of cancellation due to illness or accident.

COURSE AND ACCOMMODATION CANCELLATION FEES

• Up to 6 weeks before the start date > Full refund
• Between 6 and 4 weeks before the start date > Deposit (€150)
• 4 weeks or less before the start date > No refund
• All refunds are subject to a flat fee of 30€, including those for overpayment.
• An administration fee of 50€ may be deducted or charged from any changes made.
• FUIA will not refund any fees due to absence or illness.

1. Check-in is on Sundays after 2 PM, check-out on Saturdays before 12 PM.
2. Students staying in an accommodation organized by SITS must leave a copy of their ID or Passport and pay €50 deposit on their first day of class. The deposit will be retained for the duration of the stay. The deposit will be returned at the FUIA reception on the last day of class, provided that the house rules have been kept, the apartment is seen to be clean and tidy, and there is no damage to the fixtures and fittings.

The course price includes weekly leisure activities, internet access, and a course attendance certificate. Additional material or books used in the course are not included in the course fee. Travel and the cost of weekend activities are not included in the price. One Trial Surf lesson has an additional cost.

Extracurricular activities: Free time activities arranged by SITS are an additional service provided, with the school as an intermediary party. Although we always care for the service provided and communicate frequently with the operating partners we do not take responsibility for their actions. Accordingly, we also inform you that, when accidents occur during the free time activities, the damages should be assumed by your insurance or the insurance of the operating partners.

Trial Surfing Lesson: One trial surf lesson has an additional cost. The lesson can only be organised for a minimum of 3 and a maximum of 6 people. If more than 6 people sign up for the trial lesson, we hold the right to either withdraw the participants or to organise a second surf day.

Surf course: Once the surf course has been started, SITS will not refund any fees due to absence, illness, or fear of waves. Surfing requires a certain level of fitness and is not a sport for everyone, therefore we strongly recommend doing a trial surf lesson before booking a whole surf course.

During trainings and extracurricular activities we often take pictures or record videos of our clients. If you do not consent to pictures of you being published on our website, Facebook or other media related to the school, please advise us in advance so that we can take it into account.

The school’s insurance provides cover for accident/injury on the school premises only. Clients are not insured by SITS against illness, theft, damage or loss of personal effects and SITS accepts no responsibility in the event of such an occurrence. You must have your own personal insurance for the duration of your stay.
Health Insurance – As an EU citizen you may be entitled to free medical treatment in Spain (please check before leaving your country). However, clients are strongly recommended to take out full travel, health, money and baggage insurance in advance. EU nationals should also bring their EU Health Insurance Card (EHIC) or Form E 111.

Participants are expected to display impeccable and disciplined conduct toward landlords, roommates, fellow-participants, and all SITS staff members. SITS reserves the right to refuse admission or terminate the contract without notice and without a refund of fees, in the event of misconduct, unsatisfactory attendance or unsatisfactory work. In the event of unruly behaviour, as well as violations of Spanish law (e.g., theft, drug abuse, damage to property or personal injury, illegal downloads), SITS reserves the right to immediately exclude participants from the course or program. The participant or their parent/guardian must then cover the costs for early departure.Click edit button to change this text.
